New Mexico Teen Charged With Fatally Injuring Her Newborn At The Hospital

A 19-year-old woman from New Mexico is facing fatal injury charges after allegedly giving birth to a baby boy in a hospital bathroom and throwing him in a trash can. He was later found deceased by staff. Alexee Trevizo was arrested on May 10, more than three months after the incident. She is charged with first-degree fatal injury and alternatively intentional abuse of a child resulting in demise and tampering with evidence. According to authorities, Trevizo went to the hospital with complaints of lower back pain and was told by medical staff that she was pregnant after lab tests. She denied ever having physical relations and locked herself in a bathroom for about 20 to 30 minutes. While in the bathroom; she allegedly delivered her baby and placed him in a trash bag. The hospital staff heard the toilet flush multiple times and tried to get Trevizo out of the bathroom. When she finally came out, they found the bathroom unsanitary and the trash bag was heavier than usual. They discovered the lifeless newborn inside of the bag and called emergency. Trevizo told authorities that the baby was not breathing or crying when he was born and that she panicked and threw him in the trash. However,

an autopsy performed by the New Mexico Office of the Medical Investigator determined that the baby passed away a lack of oxygen. The autopsy also found air in the baby’s lungs and injuries indicating that he likely suffocated after birth. Trevizo’s mother, who accompanied her to the hospital, was shocked and angry when she learned what her daughter had done. She said she had asked Trevizo several times if she was pregnant and that Trevizo had lied to her. Trevizo’s attorney, Gary Mitchell, said that his client is innocent and that she was failed by the hospital staff who did not help her during her labor. He said that Trevizo has no criminal record and that there are major discrepancies about what happened in the hospital. Trevizo was released from custody on May 16 on a $100,000 unsecured bond. She is required to attend counseling and follow a curfew from 7 a.m. to 7 p.m. She is also allowed to attend school and graduation, but was asked by her high school not to go to the ceremony because of the controversy in the community. She has pleaded not guilty to all charges and is awaiting trial. If convicted, she could face life imprisonment without parole.
